Trusts

A trust allows you to protect your property and assets during your lifetime or after death. Trusts are particularly useful for protecting your home from care home fees, managing Inheritance Tax liability, and ensuring that your assets are looked after for future generations.

We set up a range of trusts to suit different circumstances, and our consultants will explain clearly which type is most appropriate for your situation.

  • Property Protection Trusts β€” safeguard your home
  • Life Interest Trusts β€” protect a surviving partner
  • Discretionary Trusts β€” flexible distribution to beneficiaries
  • Asset Protection Trusts β€” ring-fence assets from care fees
  • Family Trusts β€” manage wealth across generations
  • Funeral Trusts β€” prepay and protect funeral costs

Lasting Power of Attorney (LPA)

A Lasting Power of Attorney (LPA) is one of the most important documents you can put in place. It allows you to appoint a trusted person to make decisions on your behalf should you become unable to do so yourself β€” whether through illness, accident or mental incapacity.

There are two types of LPA, and we strongly recommend putting both in place. Without an LPA, even your closest relatives may be unable to access your bank accounts or make medical decisions for you.

  • Property & Financial Affairs LPA β€” manage bank accounts, bills and property
  • Health & Welfare LPA β€” medical decisions, living arrangements, care preferences
  • Full guidance on choosing your attorneys
  • Completion of all OPG registration forms
  • Liaison with the Office of the Public Guardian
  • Certificate provider arranged where needed

Frequently Asked Questions

Trust Price Wills is not a firm of solicitors and is not regulated by the Solicitors Regulation Authority. Our consultants are qualified, experienced will writers who are fully insured. The will writing industry is not currently regulated in the UK, but we adhere to the professional standards of will writing associations and hold full professional indemnity insurance.
Yes. Your will can be updated at any time. Minor changes can be made using a Codicil (a formal amendment). For more significant changes, we recommend creating an entirely new will. Major life events β€” marriage, divorce, children, property purchase β€” often warrant a review. We offer a will review service for all existing clients.
Yes β€” significantly. Marriage automatically revokes any existing will in England and Wales, meaning your previous will is no longer valid. Divorce does not revoke a will but removes your former spouse as a beneficiary. We strongly recommend reviewing your will after any major relationship change.
A Property Protection Trust (PPT) is written into your will. When the first partner dies, their share of the property passes into the trust rather than directly to the surviving partner. This means that share is protected β€” it cannot be used to fund care home fees or pass to a new partner's family. The surviving partner retains the right to live in the property for life. This is one of the most effective ways to protect your home for your children.
Yes β€” your will only takes effect after you die. An LPA is for situations where you are still alive but unable to make decisions. Without an LPA, even your family may be unable to access your bank accounts, pay your bills, or make decisions about your care. Setting up an LPA while you are still well and mentally capable is strongly recommended for everyone.
